Please understand all of our Terms before registering or using this Site. TRAC reserves the right to change these Terms at any time with or without notice to you. All changes to Terms are effective immediately upon posting. Your continued use of the Site following any changes to our Terms indicates your acceptance of the changes.

1. You agree that TRAC, in its sole and absolute discretion, may terminate any auction or use of the service immediately and without notice if (a) we believe that you are not abiding by the rules of this Site; (b) you have listed a suspicious or prohibited item, or one that you do not have the authority to sell; or (c) we believe you to be a non-paying bidder or non-performing seller. In most cases when we suspect foul play we will suspend your account/listing while we investigate further. If our investigation is conclusive then your account with us will be terminated. This will not relieve you of your responsibility to make any outstanding payments, which will be due and payable immediately.

2. You are solely responsible for the information provided in connection with your auctions as well as your actions and inactions through this Site. You must safeguard your login credentials. You must ensure that your participation in the selling or buying of items does not violate any applicable laws or regulations. You must verify that you entitled to sell or buy the relevant item and that you are not prohibited from doing so by any law or regulation.

3. You must not transmit through this Site any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material. You must also not transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable law or regulation.

4. Membership is only available to those who can form a legally binding contract so you must be 18 years or older to register. If any visitor provides false information in his or her registration, the account in question will be terminated immediately upon discovery. Auctions may be restricted to ID-verified members and subject to Registration Deposits and additional terms, conditions and requirements. By participating in an auction, you authorize TRAC to verify your qualification to bid at any point prior to or after your first bid. TRAC reserves the right to strike any online bid if the bidder refuses or fails to timely cooperate with our efforts to verify qualification to bid.

5. This Site acts as a forum for sellers to conduct auctions and for bidders to bid on sellers' auctions. Unless an auction is clearly identified as an auction being conducted by TRAC as agent of the seller, TRAC is not involved in the transaction between buyers and sellers. As a result, TRAC has no control over the quality, safety or legality of the items listed, the truth or accuracy of the listings, the ability of sellers to sell items or the ability of buyers to buy items. We cannot and do not control whether or not sellers will complete the sale of items they offer or buyers will complete the purchases of items they bid on. There are risks of dealing with foreign nationals, underage persons and people acting under false pretense, although TRAC does make efforts to verify identity and promote transparent transactions.

6. TRAC shall not be responsible for any items sold by auction, for any damage to items during transit or during any applicable inspection period, nor for misrepresentations and/or breaches of contract by either buyer or seller. TRAC shall not be responsible for the cost of procurement of substitute goods or any losses resulting from any goods purchased or obtained. TRAC assumes no liability for the contents of listings, software malfunctions, system errors, or for any other matter either expressed or implied.

7. For those auctions in which TRAC does represent the seller, TRAC reserves the right to withdraw the item or property from auction at any time and/or to sell through either online or offline means. Any information concerning the item or property is obtained from sources deemed reliable but not guaranteed.

8. TRAC reserves the right to change the fee structure associated with our auctions at any time. Current fees can always be found by clicking on the Site Fees tab. Your continued use of the Site following any changes to fees indicates your acceptance of the changes.

9. Auctions involving real estate and government forfeited items/police auctions may be subject to additional terms and conditions.

10. These Terms shall be governed by and constructed in accordance with the laws of the State of Maryland without regard to conflicts of laws principles.
